، أَنَّ رَجُلا سَرَقَ مِنْ بَيْتِ الْمَالِ ، فَرُفِعَ إِلَى عَلِيٍّ فَلَمْ يَقْطَعْهُ ، ثُمَّ قَالَ : " إِنَّ لَهُ فِيهَا نَصِيبًا " . حَدَّثَنَا عَلِيٌّ ، أنا شُعْبَةُ ، قَالَ : وَسَأَلْتُ الْحَكَمَ ، فَقَالَ : لا يُقْطَعُ ، وَسَأَلْتُ حَمَّادًا ، فَقَالَ : يُقْطَعُ " .
